On April 25, 2012, the U.S. Equal Employment Opportunity Commission (EEOC) – the agency that enforces federal laws prohibiting employment discrimination – issued its "Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employment Decisions Under Title VII of the Civil Rights Act of 1964." The EEOC enforces Title VII of the Civil Rights Act of 1964 which prohibits employment discrimination based on race, color, religion, sex, or national origin. The EEOC Enforcement Guidance is part of the EEOC’s efforts to eliminate unlawful discrimination in employment screening, hiring, or retention. The purpose of this whitepaper by Employment Screening Resources (ESR) founder and CEO Lester Rosen is to go beyond simply repeating the EEOC Guidance language and instead give “real world” examples and suggestions on what employers should do now to remain in compliance with EEOC Guidance while performing criminal background checks.
