The second type of information is that needed to fulfill our services. In the case of consumers, that can include but is not limited to details concerning past employment, education, and professional credentials.   A background check may also require identification information such as social security number, date of birth and drivers license number. Without identity information, cannot fulfill its tasks. Finally, will collect contact information such as a phone number and address. This may be necessary from time to time to time to contact an applicant to clarify information, or to request a release be sent to a school or employer to obtain release of the information. In order to set up an account for an employer to run background checks, is required under the federal Fair Credit Reporting Act (FCRA) and certain state laws to obtain a Certification Agreement that will provide to an employer. For an employer that wants to register only to access reports that consumers authorize on themselves and wish to make available, only limited information is required. 
Where a consumer utilizes the services of to obtain a report on them, it is the obligation and responsibility of the consumer to control access, by the means and manner in which they maintain or make available their password. is not responsible for any unauthorized access to consumer data where the consumer has caused the access. In the event that a consumer feels they have compromised their own password, however, there is the ability for a consumer to access and to immediately set up a new password. operates in accordance with the federal Fair Credit Reporting Act (FCRA) 15 U.S.C. § 1681 et seq.
When authorized by a consumer, MyESRcheck will gather information about a person's past employment, education and professional credentials only if person has come to this site and has asked us to do so. MyESRcheck will also provide public record information and other services as described on the site. MyESRcheck only make the information available to third parties in two situations:
1.      A user has given out access to a third patty b making their password and user name available, such as an employer, landlord or financial institution in order to review and view personal information.
2.      A user has signed a consent form as part of the process that specially is aimed at providing information to a third party that has sent a consumer to the site. That can occur for example where a consumer is directed by a school or employer to specifically to obtain a background check.

In order to use this website, both a customer and any user of site information must first complete a registration form. We send all new members a welcoming email to verify password and username. Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see our choice and opt-out below.
Site and Service Updates
We also send the user site and service announcement updates. Members are not able to un-subscribe from service announcements, which contain important information about the service. We communicate with the user to provide requested services and in regards to issues relating to their account via email or phone.
Correction/Updating Personal Information:
If a user's personally identifiable information changes (such as your zip code), or if a user no longer desires our service, we will endeavor to provide a way to correct, update or remove that user's personal data provided to us. ESR does NOT send U. S. applicant information outside of the U.S. for processing. Once data leaves the U.S., the data is beyond the reach of U.S. privacy laws and there are no meaningful privacy protections. ESR believes that firms that send data outside the U.S. put applicants and employers at great risk, for no other reason then to make a little more money. In some countries, it is a well known fact that U.S. identities are stolen and used for identity theft. As a practical matter, someone in the U.S. has no ability to hire a lawyer in a foreign country to pursue legal action or contact a foreign police authority to get any action taken. The only exception is where ESR is asked to perform an international verification and the information resides outside of the U.S. Even in that situation, ESR goes to great length to protect applicant data by going directly to the school or employer. If it is necessary to have a researcher perform research in a foreign country, ESR only releases the minimum information absolutely necessary.
ESR strongly advises all employers to ask a screening firm if they send data outside of the U.S. and to seriously consider the dangers to their hiring processes and to their applicants.
